Terms and Conditions

Get Hired Live Terms & Conditions for Recruiters, effective from 22 August 2019 (“Effective Date”)
By attending a Get Hired Live event (“Event”) hosted by The Prince’s Trust (“PT” or “we”), incorporated by Royal Charter and registered as a charity in England and Wales (registered charity number 1079675) and Scotland (registered charity number SC041198) you, the Recruiter (“you”, “yours” or “Recruiter”), agree to accept the following terms and conditions (“Terms”):

1. Definitions
In these Terms the following expressions shall be given the following meanings:

1.1. “Jobseeker” a person introduced by PT to the Recruiter to be considered for an Engagement.

1.2. “Engagement” the employment, hire or other use, directly or indirectly and whether under a contract of service or contract for services or otherwise, and on a permanent, temporary or other basis, of a Job Seeker by or on behalf of the Recruiter; and ‘Engage’ and similar expressions shall be interpreted accordingly.

1.3. “Package” the anticipated annual value in money or money’s worth at the date of the commencement of the Engagement of the Job Seeker’s salary and wages includinng allowances, fees, bonuses and other remuneration arising out of or relating to the Engagement which form part of the total remuneration package.

2. PT’s Obligations

2.1. PT is responsible for delivering the Event and will use reasonable care, skill and diligence in doing so in accordance with all applicable legal requirements.

2.2. PT will offer the opportunity for you to record your feedback once a meeting with a Jobseeker has ended. The Jobseeker will then receive this feedback verbally by a member of PT staff. You may keep a copy of this feedback if you so request.

2.3. PT provides no guarantee as to the Jobseeker’s qualifications, interests or suitability in any role you may be offering.

2.4. PT do not undertake any suitability checks, including but not limited to, reference and qualification verification checks.

3. Your Obligations

3.1. At the Event you will offer live role(s) which are available with an immediate start (“Roles”).

3.2. You will deal fairly and professionally with Jobseekers in accordance with all law, regulation and good practice at all times and must not do anything to bring PT into disrepute.

3.3. Nothing in these Terms grants you a licence to use the intellectual property rights of PT which includes, but is not limited to, the trademarks and/or logos of PT or any other members of the Prince’s Trust Group.

3.4. You may only publicise your involvement with the Event with express prior written agreement from PT.

3.5. You will handle all Jobseeker data in a secure manner and in line with the Data Protection Act 2018, General Data Protection Regulation, subsequent data protection legislation and our privacy policy.

3.6. You may not contact Jobseekers or make use of their information for any purpose other than filling the Roles you have available.

3.7. We do not fall under the Conduct of Employment Agencies and Employment Business Regulations 2003. It is your responsibility to check the identity of the Jobseeker and that the Jobseeker has the experience, training, qualifications and authorisation required by law or otherwise for the position and whether there are any requirements imposed by law or otherwise for you, as the Recruiter, to meet to enable a Jobseeker to take up a position. We have not and will not carry out any suitability tests, including, but not limited to Disclosure and Barring Service (DBS) checks or reference checks.

3.8. In the event you offer a Jobseeker employment and you have any concerns with the Jobseeker during their employment, you will endeavour to contact PT in the first instance.

4. Fees & Charges

4.1. The Fees for attending the Event are either:

4.1.1. £250 as a Registration Charge plus a further £250 for each Jobseeker that you engage, either directly or indirectly, as a Placement Charge or;
4.1.2. no registration charge and 5% of the first year’s salary package for each Jobseeker engaged as a Placement Charge.
4.1.2.1. The option at 4.1.2 above is currently not available via the Event website. Please contact gethiredinfo@princes-trust.org.uk for further information.
4.1.3. In the event that no Registration Charge is paid prior to the Event then the fee structure in 4.1.2 above shall apply.

4.2. All Fees are exclusive of VAT.

4.3. Payment for Registration Charges will be via the payment page for the Site. We use the merchant GoCardless. We do not store any credit card information and will not be held liable for the actions of a third party in receipt of that information.

4.4. All Placement Charges due hereunder shall be paid by you within 15 days of the date of invoice by PT.

4.5. Registration Charges are non-refundable in the instance of your non-attendance at an Event for whatever reason.

5. Termination of a Jobseeker

5.1. In the event of a Jobseeker terminating, or you lawfully terminating, an Engagement within 8 weeks of the commencement of said engagement and:

5.1.1. all moneys as per clauses 4.1.1 and 4.1.2 have been paid in full;
5.1.2. such termination is not as a result of redundancy, pregnancy, injury or ill-health or by reason of the Candidate’s race, sex or any disability;
5.1.3. such termination has not arisen where you have entered into the Engagement with the prior or likely intention of disposing with the Jobseeker’s services or terminating employment either without proper cause or with a view to obtaining a refund unfairly;
5.1.4. you serve notice to PT in writing at its registered office of the termination of the Engagement within 7 days thereof; and
5.1.5. neither you nor any subsidiary, associated or holding company of yours shall commence re-engagement of the Jobseeker within 12 months from the Event or 6 months from the date of termination of the Engagement (whichever occurs later).

then you shall be able to attend another Event with no charges.

6. Indemnity

6.1. You will indemnify PT in respect of any claims, losses or liabilities whatsoever suffered by PT (including reasonable legal costs, disbursements and consequential losses) as a result of your breach of these Terms or your negligence in relation to these Terms.

7. Limitation of Liability of PT

7.1. For the avoidance of doubt, PT shall not be liable to the Recruiter for any loss or damage (including without limitation direct, indirect and consequential loss, loss of business, loss of income, or loss of surplus/profit) arising in connection with the performance or non-performance by the Recruiter of its obligations pursuant to this Agreement (except in respect of any death or personal injury caused by the negligence of PT or its employees acting in the course of their employment).

7.2. Subject to clause 7.1 above, our liability to you under these Terms are capped at the Charges paid by you..

8. Modern Slavery

8.1. You agree to comply with all applicable anti-slavery and human trafficking laws, statutes, regulations and codes from time to time in force including, but not limited to, the Modern Slavery Act 2015.

9. Termination

9.1. We have the right to terminate the agreement constituted by these Terms immediately if you commit a material breach of these Terms and (if the breach is capable of remedy) fail to remedy the breach within 5 working days upon receipt of notice from PT.

10. Assignment

10.1. We may assign or subcontract any or all of our rights and obligations under these Terms to another member of the Prince’s Trust Group.

11. Amendment

11.1. We may amend these Terms from time to time. Please check these Terms to ensure you understand the terms that apply. Please refer to the Effective Date at the top of these Terms.

12. Jurisdiction

12.1. These Terms are governed by English law. Any disputes arising out of these terms will be governed by English law.

12.2. Any dispute will first be resolved by direct personal liaison between representatives of PT and you, or your nominated representative. If no agreement is reached within 1 month, then the dispute will be heard by an independent mediator to be agreed by both parties. Neither party will commence legal proceedings until the mediation procedure has been completed or has ended without mutual agreement of PT and the Recruiter.
